Society, Katargam, Bambawadi, Opp. Bala Ashram, Katargam, Surat, Gujarat – 395004, is committed to protecting the privacy and security of your personal data.
This Privacy Policy (“Policy”) explains how we collect, use, store, process, share, and protect personal information when you access or use our mobile application, software platform, and related services (collectively, the “Platform”).
By downloading, accessing, registering on, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to the practices described in this Policy, alongside our Terms of Use, Community Guidelines, and Safety Policies. If you do not agree with this Policy, you must immediately discontinue access to and use of the Platform.
1. DEFINITIONS
All capitalized terms used but not defined herein shall have the meanings assigned to them in the BICAB Terms of Use.
- "Biker" (formerly "Rider"): Any individual accessing or using the Platform to offer, share, coordinate, or facilitate a ride using a vehicle owned, possessed, or lawfully used by such individual.
- "Passenger": Any individual accessing or using the Platform to search, request, join, participate in, or avail a ride through the Platform.
- "Users" / "you" / "your": Collectively references Bikers, Passengers, or any other person accessing or using the Platform.
2. INFORMATION WE COLLECT
To deliver secure, reliable, and community-driven technology facilitation services, we collect several categories of information from and about our Users:
A. Information Provided Directly by You
- Account Registration & Onboarding: Full name, mobile number, email address, date of birth, gender, and profile picture.
- Biker Verification & Compliance Documentation: Valid driving license, vehicle registration certificate (RC), commercial or private permits (as applicable), motor vehicle insurance policy details, and background verification declarations.
- Passenger Verification: Official government-issued identification records or verification codes required for identity authentication.
- Payment and Settlement Data: Bank account numbers, UPI IDs, billing addresses, and payment credentials necessary to facilitate cost contribution reimbursements and Platform Fees through authorized third-party payment gateways.
- User Content: Feedback, ratings, reviews, complaints, customer support interactions, and communication logs exchanged via the Platform's in-app messaging features.
B. Information Collected Automatically Through Your Use of the Platform
- Real-Time Precise Location Data: We collect precise or approximate location coordinates (via GPS, Wi-Fi, and cell tower data) from your mobile device.
- For Passengers: Collected when the app is running in the foreground during ride matching and active transit.
- For Bikers: Collected when the app is running in both the foreground and background during active Ride creation, publishing, and transit to ensure route synchronization, user safety, and operational audits.
- Transaction and Ride History: Details of published rides, requested rides, pick-up/drop-off points, timestamps, route distances, cancellation records, and cost-sharing settlement tallies.
- Device and Technical Information: Device hardware model, IP address, operating system version, unique device identifiers, software crash reports, and mobile network configurations.
3. HOW WE USE YOUR INFORMATION
We process user data strictly in compliance with applicable Indian laws (including the Information Technology Act, 2000 and rules framed thereunder) for the following purposes:
- Platform Functionality & Core Services: To authenticate user accounts, match Passengers with appropriate Bikers based on route paths, and facilitate seamless coordination.
- Safety, Security, and Trust: To execute rigorous identity validation, execute document validation audits, monitor for prohibited activities, track real-time locations during emergencies, and enforce compliance with our Safety Policies.
- Financial Facilitation: To calculate, process, and settle permitted cost contributions between Users and process non-refundable Platform Fees via independent third-party payment service providers.
- Communications and Operational Updates: To send push notifications, SMS alerts, or emails regarding active ride statuses, security warnings, administrative changes, and policy modifications.
- Ratings and Platform Moderation: To evaluate user experience feedback, maintain trust thresholds, issue compliance warnings, or implement enforcement measures against account access.
- Legal Compliance & Risk Management: To investigate fraud, coordinate with law enforcement or judicial bodies at Surat, Gujarat, manage legal claims, and defend against structural vulnerabilities.
4. SHARING AND DISCLOSURE OF DATA
BICAB does not sell, trade, or rent user personal information to third parties for marketing purposes. Data sharing is limited to the following essential circumstances:
- Between Users (Bikers and Passengers): Once a ride request is formally accepted, we disclose limited profile details (such as your name, profile photo, real-time location coordinates, and vehicle make/model/license plate for Bikers) to the matched counterparty to coordinate boarding.
- With Third-Party Service Providers: We share necessary data with authorized background screening agents, document verification vendors, digital mapping APIs (e.g., Google Maps), cloud storage providers, and independent payment processors who assist us in operating our platform services.
- For Compliance and Legal Mandates: We will disclose information to regulatory agencies, statutory auditors, courts, or law enforcement bodies if required to do so by applicable Indian laws or to prevent immediate physical harm, financial fraud, or threats to community safety.
- Corporate Restructuring: In the event of a merger, acquisition, corporate asset sale, joint venture, or dissolution, user data may be securely transferred to successor entities under strictly enforced confidentiality protocols.
5. DATA SECURITY AND RETENTION
- Security Safeguards: We implement robust administrative, technical, and physical security controls to defend your personal information against unauthorized access, alteration, disclosure, or accidental destruction. This includes encrypted transit protocols (SSL/TLS) and restricted database access controls.
- Data Retention Policy: We retain your account, transactional records, and verification credentials for as long as your account remains active on the Platform. Following account deletion, we reserve the right to retain records, communications, and historical transaction logs for an extended duration as required for evidentiary compliance, financial audits, or risk-management purposes under applicable Indian statutory laws.
6. COOKIES AND TRACKING TECHNOLOGIES
Our Platform may utilize cookies, web beacons, device identifiers, and similar tracking technologies to enhance user experience. These technologies allow us to:
- Remember your preferences, language, and session states so you don't have to log in repeatedly.
- Understand usage patterns, measure feature engagement, and analyze overall Platform performance.
- You may modify your device settings to decline certain tracking technologies; however, core features of the Platform may not function optimally without them.
7. CHILDREN'S PRIVACY
The Platform and its services are not directed at, nor do we knowingly collect personal data from, children under the age of 18. Users must be at least 18 years old and possess the legal capacity to enter into binding agreements to use the Platform. If we discover that a user is under 18, their account will be suspended and associated personal data will be deleted in accordance with applicable law.
8. YOUR RIGHTS AND CHOICES
- Account Correction and Access: You can review, update, or modify your baseline registration profile directly through your account dashboard.
- Location Permissions: You may disable precise location tracking through your mobile device settings; however, doing so will render most ride facilitation, cost-sharing, and tracking features non-functional.
- Account Deletion: You can request the formal deactivation and deletion of your account through in-app channels or by contacting support. Your account will not be fully expunged if there are pending disputes, un-settled cost contributions, or unresolved safety investigations attached to it.
9. AMENDMENTS TO THIS POLICY
BICAB reserves the right to amend, modify, update, or replace this Privacy Policy at any time. Any changes made will be posted directly to this page with an updated "Last Updated" date. Your continued use of the Platform after changes have been published constitutes your express acceptance of the revised privacy standards.
